The court observed that the charge of rape was not proved. There was no evidence of coercion in the medical report. The victim was pregnant for 5 months. There were no such marks to say that it was forced. The report was also written by husband and father-in-law three days after the incident.
The district court had sentenced him to 10 years in prison for misconduct and life imprisonment in the crime of SC / ST Act and was in jail since the year 2000.
